Article 1. Use of the website

1.1

If the website offers an extra secure environment, you must first register in order to use all functionalities of the website. Once your registration has been completed and your account, if necessary, has been approved by CBA Apotheek, you can log in to your account immediately and make full use of the services offered.

1.2

If you have an account, you must protect access to your account by means of your username and password against unauthorised use. In particular, you must keep the password strictly confidential. CBA Apotheek may assume that anything that happens from your account after login with your username and password is done under your direction and supervision. You are therefore liable for all such actions, unless you have reported to CBA Apotheek that another person knows your password.

1.3

If required for the service you request, CBA Apotheek may ask you to provide additional identifying information before the requested service is provided.

1.4

CBA Apotheek reserves the right to refuse registrations without giving reasons.

1.5

The medical information on the website is for general informational purposes only and can never be considered a substitute for a consultation with a specialist. Always contact CBA Apotheek for personal advice.

Your personal data may be processed via the website. Please consult the privacy policy of CBA Apotheek for more information.

Article 2. Rules of use

2.1

It is prohibited to use the website for actions and/or behaviour that are contrary to Dutch or other applicable laws and regulations, or to public order and morality.

2.2

If CBA Apotheek establishes that you are violating the above conditions, or receives a complaint in this regard, it will warn you. If this does not lead to an acceptable solution, CBA Apotheek may intervene itself to end the violation. In urgent or serious cases, CBA Apotheek may intervene without warning.

2.3

If, in the opinion of CBA Apotheek, nuisance, damage or other danger arises for the functioning of the computer systems or network of CBA Apotheek or third parties and/or of the internet service, in particular through excessive sending of email or other data, leakage of personal data or activities involving viruses, Trojans and similar software, CBA Apotheek is entitled to take all measures it reasonably deems necessary to avert or prevent this danger.

2.4

CBA Apotheek is at all times entitled to report detected criminal offences to the authorities. Furthermore, CBA Apotheek is entitled to provide your name, address, IP address and other identifying data to a third party who complains that you are infringing their rights or these terms of use, provided that the validity of that complaint is reasonably sufficiently plausible, there is no other way to obtain such data, and the third party has a legitimate interest in receiving the data.

2.5

CBA Apotheek reserves the right to recover from you any damages resulting from violations of these terms of use.

Article 3. Availability and maintenance

3.1

CBA Apotheek actively maintains the website. If maintenance is expected to limit availability, CBA Apotheek will carry this out when the number of visitors is relatively low. Maintenance in connection with emergencies can take place at any time.

3.2

CBA Apotheek may from time to time adapt the website and the functionalities on the website.

Article 4. Intellectual property

4.1

The website, the associated software, as well as all information and images on the website are the intellectual property of CBA Apotheek or its licensors. These may not be copied or used in any way without separate written permission from CBA Apotheek, except in cases where this is legally permitted.

Article 5. Duration and termination

5.1

Once you create an account, you enter into an agreement with CBA Apotheek. This agreement is valid for an indefinite period and gives you the right to use the services on the website in accordance with these terms of use.

5.2

You may terminate the agreement at any time with immediate effect by notifying CBA Apotheek by email.

5.3

CBA Apotheek is entitled to terminate the agreement if you have not used your account for eighteen months. In that case, it will first send a reminder email to the email address linked to your account.

Article 6. Changes to prices and terms

6.1

CBA Apotheek may amend these terms at any time.

6.2

CBA Apotheek will announce amendments or additions to these terms of use at least fourteen days before they take effect, via the website, so that you can take note of them. Minor changes will take effect without notice.

6.3

If you do not wish to accept an amendment or addition, you may terminate the agreement up to the effective date. Use of the website after the effective date constitutes acceptance of the amended or supplemented terms.

Article 7. Other provisions

7.1

These terms of use are governed by Dutch law.

7.2

Unless otherwise required by mandatory law, all disputes relating to the website shall be submitted to the competent Dutch court in the district in which CBA Apotheek is established.

7.3

If you request an eConsult or repeat prescription via CBA Apotheek, the 2007 Guideline on online doctor–patient contact applies. You can consult this guideline upon request, or download it via the KNMG website.

7.4

If any provision in these terms of use proves to be void, this shall not affect the validity of the entire terms. In that case, the parties will establish one or more new provisions to replace it, reflecting the intent of the original provision as closely as legally possible.

7.5

CBA Apotheek is entitled to transfer its rights and obligations under the agreement to a third party that takes over the website or the relevant business activity.

7.6

Deviations from these terms of use are only binding if accepted in writing by CBA Apotheek.
